On promulgating the Vietnam’s Products and Tariff rates to implement the Common Effective Preferential Tariff Scheme (CEPT) for ASEAN Free Trade Area (AFTA) for year 2002

Pursuant to the Law on Organization of the Government dated 30^th September 1992;

Pursuant to the Law on Import- Export Duties dated 26^th December 1991; Law on amendments of some articles of Law on Import- Export Duties dated 5^th July 1993 and Law on amendments of some articles of Law on Import- Export Duties No. 04/1998/QH10 dated 20^th May 1998;

Pursuant to the Resolution No. 292/NQ-UBTVQH9 dated 8^th November 1995 of the Standing Committee of the National Assembly on Vietnam’s Tariff Reduction Program for the Implementation of the ASEAN Agreement on Common Effective Preferential Tariff (CEPT) Scheme;

In accordance with the proposal of the Minister of Finance,

Decrees

Article 1.       To promulgate along with the Decree the Vietnam’s Products and Tariff rates to implement the Common Effective Preferential Tariff Scheme (CEPT) for ASEAN Free Trade Area (AFTA) for year 2002.

Article 2.       The Ministry of Finance shall provide guidance on the implementation of the Decree pursuant to the provisions of the ASEAN Agreement to implement the Common Effective Preferential Tariff Scheme (CEPT) for ASEAN Free Trade Area (AFTA).

Article 3.       The Decree shall come into effect since 1^st January 2002. The Ministers, the Heads of Ministerial – level Agencies and Organs under the Government and the Chairmen of the People’s Committees of the provinces and cities under the Central Authority are responsible for implementing the Decree.

C¨n cø LuËt thuÕ xuÊt khÈu, thuÕ nhËp khÈu ngµy 26 th¸ng 12 n¨m 1991; LuËt söa ®æi, bæ sung mét sè ®iÒu cña LuËt thuÕ xuÊt khÈu, thuÕ nhËp khÈu ngµy 05 th¸ng 07 n¨m 1993 vµ LuËt söa ®æi, bæ sung mét sè ®iÒu cña LuËt thuÕ xuÊt khÈu, thuÕ nhËp khÈu sè 04/1998/QH10 ngµy 20 th¸ng 05 n¨m 1998;

C¨n cø NghÞ quyÕt sè 292/NQ-UBTVQH9 ngµy 08 th¸ng 11 n¨m 1995 cña Uû ban Th­êng vô Quèc héi vÒ Ch­¬ng tr×nh gi¶m thuÕ nhËp khÈu cña ViÖt Nam ®Ó thùc hiÖn HiÖp ®Þnh ¦u ®·i thuÕ quan cã hiÖu lùc chung (CEPT) cña c¸c n­íc ASEAN;

Theo ®Ò nghÞ cña Bé tr­ëng Bé Tµi chÝnh,

NghÞ ®Þnh:

§iÒu 1. Ban hµnh kÌm theo NghÞ ®Þnh nµy Danh môc hµng ho¸ vµ thuÕ suÊt c¸c mÆt hµng cña ViÖt Nam ®Ó thùc hiÖn HiÖp ®Þnh vÒ ¦u ®·i thuÕ quan cã hiÖu lùc chung (CEPT) cña c¸c n­íc ASEAN cho n¨m 2002.

§iÒu 2. Bé Tµi chÝnh h­íng dÉn chi tiÕt thi hµnh NghÞ ®Þnh nµy.

§iÒu 3. NghÞ ®Þnh nµy cã hiÖu lùc tõ ngµy 01 th¸ng 01 n¨m 2002. C¸c Bé tr­ëng, Thñ tr­ëng c¬ quan ngang Bé, Thñ tr­ëng c¬ quan thuéc ChÝnh phñ vµ Chñ tÞch Uû ban nh©n d©n tØnh, thµnh phè trùc thuéc Trung ­¬ng chÞu tr¸ch nhiÖm thi hµnh NghÞ ®Þnh nµy./.
